Please read these Terms and Conditions carefully before using the Swapix website or any of our services. By accessing our website or placing an order, you agree to be bound by the terms below. If you do not agree, please do not use our services.
1. About Us
Swapix is a UK-based marketplace for buying, selling, and repairing mobile phones and electronics, operating stores in Leicester and Birmingham. Our website is located at swapix.co.uk.
References to "Swapix", "we", "us", or "our" in these terms refer to the Swapix business and its operators.
2. Using Our Website
You may use our website for lawful personal purposes only. You agree not to:
- Use the site in any way that breaches any applicable local, national, or international law or regulation.
- Transmit any unsolicited or unauthorised advertising or promotional material.
- Attempt to gain unauthorised access to our systems, servers, or databases.
- Interfere with the proper working of our website or services.
- Post or transmit any content that is defamatory, offensive, or harmful.
We reserve the right to suspend or remove access to our website at any time without notice for users who violate these terms.
3. Account Registration
To access certain features (order tracking, saved addresses, purchase history), you may register for an account. By registering, you agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your password and not share it with third parties.
- Accept responsibility for all activity that occurs under your account.
- Notify us immediately at hello@swapix.co.uk if you suspect unauthorised use of your account.
We reserve the right to close accounts that are inactive for over 24 months or that are used in violation of these terms.
4. Buying Products
All products listed on our website are subject to availability. Placing an item in your basket does not guarantee availability; the sale is only confirmed once you receive an order confirmation email.
- Prices are displayed in GBP (£) and include VAT where applicable.
- We reserve the right to cancel any order where a pricing error has occurred; you will receive a full refund if payment was taken.
- Images and descriptions are for illustrative purposes. Pre-owned devices may vary slightly from the images shown.
5. Product Grading
Pre-owned devices are graded at the time of inspection. Grades are defined as follows:
- Grade A (Excellent): Minimal to no signs of use. Screen and body in near-perfect condition.
- Grade B (Good): Light scratches visible under close inspection. Fully functional.
- Grade C (Fair): Noticeable scratches or scuffs on screen or body. Fully functional.
- Grade D (Poor): Heavy wear, possible chips or dents. Sold as-is, primarily for parts or repair.
Grading is carried out by trained Swapix staff. Whilst we take care to be accurate, condition assessments are subjective and you may return a device if it does not match its stated grade (see our Returns Policy).
6. Payment
We accept payment via credit/debit card and other methods shown at checkout. All payments are processed securely. We do not store card details on our systems.
For in-store purchases we also accept cash. Swapix does not offer credit or instalment plans unless explicitly advertised for a specific promotion.
7. Delivery
For online orders, delivery timescales and charges are displayed at checkout. We use reputable couriers for UK deliveries. Swapix is not responsible for delays caused by the courier once the parcel has been dispatched, but we will assist in resolving any delivery issues.
Risk in goods passes to you upon delivery. Title passes upon full payment.
8. Selling & Trade-In
By offering a device for sale or trade-in to Swapix, you confirm that:
- You are the legal owner of the device, or are authorised to sell it.
- The device is not subject to any finance agreement, rental, or lease.
- The device has not been reported as lost or stolen and is not network-locked for fraudulent reasons.
- You have removed all personal data (factory reset) before handing over the device.
Swapix reserves the right to cancel a trade-in, withhold payment, and report any device to the relevant authorities if it is found to be flagged as lost, stolen, or associated with fraud. We may require valid photo ID before completing a trade.
9. Repair Services
By booking a repair with Swapix, you agree to the following:
- You authorise Swapix technicians to disassemble the device as required to perform the agreed repair.
- You have backed up all personal data before leaving the device with us. Swapix is not liable for data loss.
- A quote will be provided before work begins. If the actual repair requires additional work beyond the quoted scope, we will contact you for authorisation before proceeding.
- If you decline a repair after disassembly, a diagnostic or reassembly fee may apply.
- Uncollected devices will be held for 30 days after repair completion. After 90 days, uncollected devices may be recycled or sold to recover costs, with notice given where possible.
10. Intellectual Property
All content on this website — including text, images, logos, and software — is owned by or licensed to Swapix and is protected by UK and international copyright laws. You may not copy, reproduce, or distribute any content without our prior written consent.
11. Limitation of Liability
To the fullest extent permitted by UK law, Swapix shall not be liable for:
- Any indirect or consequential loss arising from your use of our website or services.
- Loss of data, profits, or business opportunities.
- Any failure or delay caused by circumstances outside our reasonable control (force majeure).
Nothing in these terms limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under English law.
12. Changes to These Terms
We may update these Terms and Conditions from time to time. Changes will be posted on this page with an updated date. Continued use of our website after any changes constitutes acceptance of the new terms.
13. Governing Law
These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
